1. Acceptance of Terms
By accessing and using the services provided by DGKAP EDUTECH PRIVATE LIMITED (“Company”, “we”, “our”, or “us”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you are advised not to use our services or website.

2. Services
DGKAP EDUTECH PRIVATE LIMITED provides customized digital solutions including but not limited to platform development, marketing, advertising, learning management systems, business automation, and technology-based operational support for educational institutions, entrepreneurs, and course creators.

3. Intellectual Property
All content, designs, strategies, frameworks, and software provided or developed under our services are the exclusive property of DGKAP EDUTECH PRIVATE LIMITED unless explicitly transferred through written agreement. Unauthorized use, reproduction, or distribution of any intellectual property is strictly prohibited and may result in legal action.

4. Confidentiality
Both parties shall maintain the confidentiality of proprietary or sensitive information shared during and after the engagement. Disclosure of any such information to third parties without prior written consent is not permitted, except where required by law.

5. Payment Terms
All payments are to be made in accordance with the mutually agreed terms outlined in the proposal or service agreement. Any delay in payments may attract late fees and/or service suspension. All applicable taxes, including GST, are to be borne by the client unless exempted under Indian law.

6. Refund and Cancellation Policy
6.1 Client-Initiated Cancellation
If the client unilaterally decides to discontinue or cancel the project or services for any reason, the company shall not be held liable to issue any refund of the amount paid.
6.2 No Refund After 30 Days of Work Initiation
Once 30 days have passed from the official work initiation date, under no circumstances shall a refund be processed. This is due to the commitment of resources, vendor payments, and internal costs incurred by the company.
6.3 Force Majeure and Regulatory Restrictions
In the event that government regulations, legal restrictions, or force majeure conditions (including but not limited to pandemics, government orders, or internet restrictions) prevent the continuation or completion of services, no refunds shall be made. Such events are outside the control of the company.
6.4 Discretionary Alternative Projects
In rare cases, the company may, at its sole discretion, choose to extend support on a different project in lieu of the original assignment. However, this is entirely at the discretion of DGKAP EDUTECH PRIVATE LIMITED and shall not be treated as a client entitlement.

All communication regarding refunds, cancellations, disputes, or grievances must be submitted in writing to our official email address: info@dgkapedutech.com
Any communication made via other means such as WhatsApp, SMS, social media, or verbal discussions shall not be considered official and shall have no legal standing or binding effect.

8. Limitation of Liability
DGKAP EDUTECH PRIVATE LIMITED shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, including but not limited to loss of revenue, data, or goodwill. Our total liability shall be limited to the amount paid by the client for the specific service in question.

9. Use of Third-Party Services
Our services may integrate with or rely on third-party platforms, APIs, and tools. We are not responsible for any issues, service outages, or limitations originating from such third-party providers. The client understands and accepts the inherent risks involved.

10. Modifications to Terms
We reserve the right to amend or update these Terms at any time without prior notice. Continued use of our services after such changes implies your acceptance of the revised terms.

11. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. All disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Delhi, India.
